H1 tag similar to title.Is this spam?

Hi, my site is ranked well on msn, but not on google or Yahoo.
I was previously told that I was in google sandbox.Yet for some reason for about 1 week it ranked well in google then dropped out, that was about 3 months ago.
But what about yahoo.Do they have sandbox?
Also If your H1 tag is similar to your title page does yahoo and google class this as spaming?
Also google says I have 9 links, but according to alexa I have none.Why?

Having a h1 tag the same as the title shouldn't cause them to penalise you.
A h1 should be used as an on page title. But personally i wouldnt make it exactly the same as the title, But a variation of it.

If your title is "car rental in japan" you h1 should be something like "Japan car rental".

stOx is right, you shouldn't get penalized for having h1 and title the same but you should try to switch the words around remembering to keep the relevent keywords.

I'm curious to know how there can be a sandbox checker tool if there isn't even evidence of there even being a sandbox, at least that's what I've heard.

It would be impossible to check to see if a site is in a sandbox because google haven't exactlly admitted that there is a "sandbox" so they aren't going to say what the sandbox would do.

However, Matt Cutts has said that some sites may experiance a delay in ranking when they are new sites, Though he didn't call this effect the "sandbox".

So if there is an effect that may be percieved as a sandbox, that makes it a sandbox doesn't it? I would have thought so.

Either way, Whatever you want to call it, There is something in the google algo that means new sites find it harder to rank well than old sites.

I know that some say there is a sandbox and some say no.

That site only reports on SERPS. A site could just have bad SEO or minimal backlinks to not rank well, It doesn't mean it's in the sandbox.

I don't think this is spam. I also think there is such a thing as the Google SandBox - there has to be since I have had sites that don't even rank for the top 1000 for a keyword, yet the results in the 5th page aren't even remotely related to the keyword.
